Big blow to Italian company, stopped from selling products with names similar to Amul
The Delhi High Court has temporarily restrained Italian company Terre Primitive from selling, marketing and advertising the product and selling cookies and chocolate covered biscuits with names like “Amul”. The court has imposed this ban on the company till the next hearing of the case on January 7. Terre Primitive has also been ordered to remove the list of products named “Amulet” from its website.
The court has given this order while hearing the petition of Gujarat Cooperative Milk Marketing Federation Limited, which sells dairy products and other products under the Amul brand name. The court asked the Italian company to hand over its products being sold under the name “Amuleti” to Gujarat Milk Federation for destruction.
Ban on sales, marketing and advertising
Along with this, the court has also ordered to remove the social media pages of all the products being sold under the name “Amuli”. Issuing notice to the Italian company, Delhi High Court has fixed January 7 for the next hearing of this case.
The court said in its order that in view of the circumstances, Amul has filed a petition to ban the sale, marketing and advertisement of the products of the Italian company, prima facie a case appears to be made out and if an interim ban is not imposed on it. If this happens, the petitioner will suffer irreparable loss.
The court further said that in this case the balance of convenience also appears to be in favor of Amul and against the Italian company.
The High Court was hearing a lawsuit filed by the Gujarat Milk Federation against an Italian company for trademark infringement for selling cookies and chocolate-covered biscuits under the name “Amuleti”.The federation (Amul) said that the Italian company’s mark and its “Amul” trademark appear very similar. It is natural for this to create confusion in the minds of ignorant and innocent people.
